The objective of this paper is to reflect on the organization and the occupation of urban space which can be seen as a result of the transformations which occurred in the spheres of power of the Brazilian state from the late 1980ies onwards. As well, the impacts of the legal structure and the public policies adopted by Brazil during the 90ies regarding the basic right of free movement and accessibility of the population in the urban sphere of cities of the 21st century. The research is descriptive, having the objective of presenting the main characteristics of the studied phenomenon, of highlighting important variables in this context, in order to better understand its nature and the respective correlations. The applied research methods are bibliographic research, participative observation, and the analysis of relevant documents. The present paper will present the preliminary results of the first stage of the research work.

O objetivo do presente estudo é apresentar reflexões sobre a organização e a ocupação do espaço urbano, resultado das transformações ocorridas nas esferas de poder do Estado brasileiro a partir do final da década de 80, e os impactos da estrutura legal e das políticas públicas adotadas pelo Brasil nos anos 90 na garantia do direito fundamental de ir e vir e na acessibilidade da população no ambiente urbano das cidades do século XXI. A pesquisa é do tipo descritiva, pois tem o propósito de expor as características do fenômeno estudado, de elucidar variáveis importantes nessa discussão, compreendendo a sua natureza e a correlação entre as mesmas. Os meios de investigação utilizados foram a pesquisa bibliográfica, a observação participante e a análise documental. O presente artigo se propõe a apresentar os resultados preliminares da primeira etapa do trabalho de investigação.
