Abstract
In the recent Developmental History of Trinidad and Tobago there has been the passing of the Mediation Act of
2004 (Act Number 8), and considerable cabinet talk on the development of a Civil Society Board under the
purview of the Ministry of National Diversity and Social Integration. These realities beg us to consider whether or
not our beloved country needs Mediation in the form adopted above and for that matter any other method of
Conflict Resolution, and furthermore whether or not we classify as a civil society. This paper therefore will seek to
explore and discuss, from a global and contextual point, these fundamental questions, and whether contemporary
Trinidad and Tobago is in fact in need of Conflict Resolution. It must be noted that this paper takes its exodus
from the reality that within the context of Trinidad and Tobago the prime formalised method of conflict resolution
is litigation and as such, the exploration focuses on Alternative Dispute Resolution method as opposed to the
courts.
